Terms of Use (TravelPassport)

These Terms of Use (“Terms”) govern the use of the TravelPassport application (“App”) provided by MGate Co., Ltd. (“Company”).

Scope

These Terms apply to all relationships between the Company and users regarding the use of the App.

Service Description

The App provides tools for managing and organizing travel-related information.

The App is intended to support travel planning and management and does not guarantee the accuracy of any information provided.

Travel Pass

The App offers a paid feature called “Travel Pass.”

Travel Pass has the following characteristics:

  • It is available for a fixed period upon a one-time purchase
  • Usage begins immediately after purchase
  • It does not automatically renew

The scope and functionality of Travel Pass are subject to what is displayed within the App.

Payment

All payments are processed through the Apple App Store.

Pricing and billing conditions are determined by the App Store.

Refunds

Refunds are handled in accordance with Apple’s policies.

The Company does not provide direct refunds.

Purchase Synchronization

Travel Pass purchases are made through the App Store.

The activation and synchronization of purchase status may require verification and synchronization through the Company’s systems.

An internet connection and appropriate user authentication may be required to synchronize purchase information.

Account and Data Management

Users are responsible for managing their use of the App and any data they store within it.

Prohibited Conduct

Users must not:

  • Violate any applicable laws or regulations
  • Interfere with the operation of the App
  • Attempt unauthorized access
  • Engage in any other conduct deemed inappropriate by the Company

Changes and Suspension of Service


The Company may modify or discontinue the App at any time if deemed necessary.

Disclaimer

To the maximum extent permitted by law, the Company shall not be liable for damages arising from the use of the App, except in cases of willful misconduct or gross negligence.

The Company shall not be liable for:

  • Data loss, corruption, or leakage
  • Issues arising from third-party services
  • Accuracy of AI-generated results
  • Decisions made by users based on information provided by the App
  • Interruptions or unavailability of the App

Apple-Specific Terms

1. Acknowledgement:
These Terms are concluded between the User and the Company, not with Apple. The Company, not Apple, is solely responsible for the App and its content and services.

2. Applicable Terms:
Your use of the App is subject to these Terms, Apple’s Standard End User License Agreement (EULA) (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/), and the Apple Media Services Terms and Conditions (https://www.apple.com/legal/internet-services/itunes/jp/terms.html). In the event of any conflict, the Apple Media Services Terms and Conditions shall prevail.

3. Scope of License: 
The App is licensed, not sold, to the user.
The license is limited, non-transferable, and granted for use on Apple-branded devices in accordance with Apple’s usage rules.

4. Maintenance and Support: 
The Company is solely responsible for providing any maintenance and support for the App, except as required by applicable law. The User and the Company acknowledge that Apple has no obligation to provide any maintenance or support services for the App.

5. Warranty:
The App is provided “as is” and, to the maximum extent permitted by law, without warranty of any kind. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of the Company.

6. Product Claims:
The User and the Company acknowledge that the Company, not Apple, is responsible for addressing any claims by the User or any third party relating to the App or the User’s possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

7. Intellectual Property Rights: 
The User and the Company acknowledge that, in the event of any third-party claim that the App or the User’s possession and use of the App infringes that third party’s intellectual property rights, the Company, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

8. Legal Compliance:
You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third Party Terms of Agreement:
You must comply with applicable third-party terms of agreement when using the App (e.g., wireless data service agreements).

10. Third Party Beneficiary: 
The User and the Company acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms, and that, upon the User’s acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against the User as a third-party beneficiary.

Intellectual Property

All content within the App is protected by intellectual property laws and belongs to the Company or rightful owners.

Governing Law and Jurisdiction

These Terms are governed by the laws of Japan.

Any disputes shall be subject to the exclusive jurisdiction of the courts having jurisdiction over the Company’s principal place of business.

Changes to These Terms

The Company may update these Terms at any time.

Changes become effective upon publication on the website.
